Health & Safety Prosecutions
This area of law is complex and highly specialised, and any person or organisation who is investigated by the Health and Safety Executive should seek legal advice.
Employers owe a number of wide ranging duties within the Health and Safety at Work Act 1974. Employees, persons in control of premises and manufacturers are also subject to regulation, with duties and responsibilities explicitly defined by the Act.
The Health and Safety regime provides the introduction of governing regulations, contravention of which may result in an offence being committed. HSE inspectors enjoy wide powers, and can issue improvement or prohibition notices, and in certain circumstances where there has been a fatality, the law allows for the prosecution of individuals and corporate bodies for manslaughter.
